1. Definitions
- “Our Company” / “We” / “Us”: Home Delivery Direct Ltd (trading as Direct Garden Buildings), 16a The Avenue, Horsforth, Leeds, LS18 5JW. Company No: 06749287 | VAT Registration No: GB 997 9233 46.
- “The Customer” / “You” / “Your”: The individual, business, or organisation purchasing goods or services from Home Delivery Direct Ltd (trading as Direct Garden Buildings), as detailed in our order, e-commerce, or invoice documentation.
2. About Direct Garden Buildings
Direct Garden Buildings is a national retailer specialising in garden buildings, offering over 2,000 products. Established in 2008, we’ve grown to be a leading UK retailer. We’re committed to traditional values, excellent customer service, fair pricing, and responsible business practices. All products are new and available in a range of qualities, styles, and finishes. Installation services are available on many products, often carried out by the manufacturer.
3. Overview and Governing Law
- These terms govern the sale and supply of garden buildings and related services by Direct Garden Buildings to you.
- We adhere to UK consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (CCRs).
- By placing an order, you enter into a legally binding contract. These terms set out and protect the rights of both parties.
- Your statutory rights as a consumer are not affected by these terms.
- These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
4. Contract Formation and Pricing
- A contract between you and us is formed once we send you written confirmation of your order, whether by email or post.
- Until such confirmation is issued, we reserve the right to cancel or refuse any order.
- While we make every effort to ensure prices are accurate, if a product is listed at an incorrect price, we reserve the right to cancel any orders prior to dispatch and refund any payment made.
5. Shortages and Damage
- Inspect goods on delivery and notify us of shortages or transit damage within 30 days of delivery (this does not affect your statutory rights).
- Report issues in writing to our address, by email to help@directgardenbuildings.co.uk, or by phone. Photos may be requested.
- If approved, we will supply (or arrange supply of) replacement parts within 5–10 working days, subject to stock.
- After the initial 30-day period, Direct Garden Buildings remains responsible under the Consumer Rights Act 2015 for providing appropriate remedies. If a fault arises within six months of delivery, it is assumed to have been present at delivery unless we prove otherwise.
- Your remedies are repair or replacement within a reasonable time and without significant inconvenience.
- If repair or replacement is impossible or unsuccessful, you are entitled to a price reduction or to reject the goods for a refund (which may include a reasonable deduction for use after the first 30 days).
- Nothing in this section limits your statutory rights.
6. Security
- Our site uses a secure e-commerce payment process approved by major UK banks.
- Payments are processed in an encrypted environment by our payment gateway provider.
- We use industry-standard TLS/SSL encryption (128-bit or stronger) for data transmission and storage.
7. Miscellaneous Provisions
- If you request order amendments after processing, a £15 administration charge may apply, in addition to any cost changes.
- If your chosen product becomes unavailable, we may offer a similar alternative or a refund.
- You must take reasonable care during assembly and use. We are not liable for damage or injury caused by misadventure, negligence, or misuse.
- Limitation of Liability: We are not liable for indirect or consequential loss (e.g. loss of profit, business, or opportunity), except where liability cannot be limited by law. Nothing limits liability for death or personal injury caused by our negligence or fraud.
- Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control (e.g. weather, strikes, transport disruption, accidents, or supply chain issues).
- Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.
